    The H-2B program is critically important for many businesses that have difficulty finding U.S. workers to fill temporary jobs. This is particularly true in seasonal industries. Comments from H-2B employers attest to the need for foreign workers in physically demanding seasonal jobs, often in remote locations, that many U.S. workers will not take.

    The H-2B nonimmigrant visa ( program permits employers to hire foreign workers to come to the U.S. and perform temporary nonagricultural work, which may be one-time, seasonal, peak load or intermittent and there are no qualified and willing U.S. workers available for the job. Note that this visa is not available for "temporary" agencies or other work placement agencies.

    In order to learn more about employers� perceptions of the H-2B program, ImmigrationWorks USA and the U.S. Chamber of Commerce conducted a survey: five short questions distributed among H-2B employers in July and August 2010. The survey asked how many H-2B workers the company had hired in the last three years and what types of jobs those workers held. It included two open-ended questions about the benefits of using the program and asked what if any problems employers had experienced.

    Another open-ended question asked what employers would do if they were not able to hire H-2B workers. Participation was voluntary, and results could be submitted via email, fax or the internet. A total of 367 employers responded. The majority of H-2B employers who responded to the survey noted that temporary foreign workers are reliable and hard-working. Many also praised these workers� productivity: a benefit that offsets the cost of bringing them into the United States. Respondents appreciated that H-2B workers were willing to work seasonal jobs and then return home when the season ended.

    Important benefit of the program is that it offers companies a way to hire foreign workers when U.S. labor markets tighten. The program increases labor market flexibility by allowing businesses to bring in foreign workers when U.S. workers move up to better, higher-paying jobs during economic expansions.

    Thanks for the reply. But I have not yet received the approval. I have just received the receipt of H1B transfer application, and I am worried if they would not approve H1B transfer application since middle name has a typo. Please reply.

    Silicon Valley Immigration Lawyer Blog Has Just Posted the Following:
    An earlier blog post "Silicon Valley Employers Need to Prepare for Surprise USCIS Visits" ( described the "new normal" of USCIS employees or contractors showing up unexpectedly and inquiring about past visa petitions and foreign national workers. A recently held Department of Homeland Security program, titled, "2009 Government and Employers: Working Together to Ensure a Legal Workforce" sheds more light onto the types of visits being conducted.

    Ronald Atkinson, Chief of Staff of USCIS' Fraud Detection and National Security (FDNS) ( D&vgnextchannel=2af29c7755cb9010VgnVCM10000045f3d6a1 RCRD) office, explained the three types of site visits that are currently being conducted:

    Risk Assessment Program fraud study. Applicable to any type of benefit program, including family and employment-based visas, this study is part of a joint program between USCIS and ICE (Immigration Customs and Enforcement). Applications and petitions are chosen at random, usually on a post-approval basis, for visits to help in designing profiles of potential fraud.

    Targeted site visits. These visits take place where fraud is suspected, and consist of a visit to ask questions. Advance notice, including notice to counsel, is supposed to be provided.

    Administrative site visits. These relate to religious worker and H-1B petitions ( They generally are conducted by contractors who know nothing of immigration law. Religious worker visits are performed under the regulations for that category. For H-1B site visits, the contractors have been equipped with a set of specific questions, and all employers/beneficiaries should be asked pretty much the same questions, primarily reaching the issues of whether there's really an employer there, whether the employer knows it filed the petition, and whether the beneficiary is doing the work and receiving the wage indicated on the petition. H-1B visits are done on a post-adjudication basis, and are randomly selected. Each employer should receive only one such visit, but may receive different visits for different sites.

    Anyone out there knows the answer?

    I am currently working for Company A which sponsors my H1B. I wonder if I can work for another company on a part time basis. What's the requirement for concurrent H1B filing? And does concurrent H1B filing requires a new H1B application against the quota? Please provide guidance.

    why do u want to work part time on H1 with multiple employers?

    Why can't u go for full time with Company A??

    My EAD expires on 07/28/2010. My EAD renewal is currently pending (applied online on 5/18/2010 at NSC). My AP expires on 08/24/2010. I am planning to apply for AP renewal once I finish my move to new address.

    So, I really don't know which date to put. BTW, USCIS online application didn't mark that field as required.

    Put the latest date ( AP ) . May be you can indicate that you are on AOS.

    so you are saying that it took 1 year for USCIS to send you NOID?
    you'd mentioned 140 withdrawl in dec2009.

    AC21 is not mandatory in my opinion ( my lawyer's too) , I changed job this Aug
    saw a soft LUD on my 4 years ago approved 140 after changing been 3 months to the soft LUD.
    seeing your pattern looks like they may send some letter but have not got any yet.

    My wife applied Sept 2nd , she got it very quickly I would say less than week. I applied Sept 17th ,called them Sept 29th ,they said u should get it by this week end. Let me know whats the result of your visit. Looks like i may have to visit them if i dont get it till this weekend. PM me your result of your visit.

    They said she can start as soon as it it approved.Only thng i am worried about is when she wants to transfer H1b what are the hurdles have to be faced.I heard or enquired that as long as Quota is there she can transfer H1B.

    Is it legally difficult because transfering from Non Profit to Regular Organization.

    I was wondering what are the benefits of EAD to primary(H1B) applicant before 180 days, i understand that AC21 & it's benefits can be invoked after 180 days from receipt date.
    But is there any benefit of having EAD if 180 days from 485 receipt date are not over ?

    I have heard this before on other forums , too.

    I believe, the USCIS CSR confused "unrestricted" SSN with a "restricted" SSN. Most people on some kind of work permit (F1,H1B, EAD) have "Eligible to work with DHS authorization" ( or something similar ) imprinted on their Social Security card ( it certainly is in my social ), and I believe people with GC/USC don't have any such thing written on their SSN ( it's purely a guess by me, I'm yet to see a GC/USC holders SS card ;) ) . So, I don't think people on work permit can work just with DL and SS card ( if they could , why would they have not done until now :confused: ? ) .

    But, on the other hand, I'd like to know, if people can continue working on the EAD receipt itself ??

    What does this mean?
    On September 10, 2007, we mailed you a notice that we have approved this I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.

    Does it mean that they mailed the letter that it is approved or did they mail the card?

    1) There are flights from Manchester, NH to Baltimore, MD for about 150$ (Flying to DC from Manchester costs an additional 100$). It is just 45 miles from Washington, DC. I have read in one of the postings that there are trains from Baltimore to DC Central. We can book hotels in DC through Priceline.

    2) If we have enough people, we may be able to drive to DC (rent a bus or a minibus from Boston) But it is at least a 10 hour drive. That means we may have to take at least half the day off on Wednesday as well. We can then start back Thursday evening itself.

    It makes sense to book hotels together as it will give us a better chance to prepare for the rally.

    I hope more people come forward. I know this is a difficult thing to do. But it is necessary.

    There are so many IV members from in and around Massachusetts and only one other has volunteered so far!
