    Hi,

    MY labor says that the candidate needs atleast 1 year exp as a Software Engineer.

    But my experience letter says that I have 2 years of experience as a Senior Software Engineer.

    Would that be ok ? (Actually I was a software engg before and got promoted to Senior Software Eng later.)

    I mean should be only Software engr in the exp letter rather than Sr Software engr ?

    Before i present my RFE I will explaing My GC:
    I did masters and worked on OPT for sometime with Company A and they applied H1B,
    still working for Company A as H1B as Senoir Programmer ANalyst.
    At one point CompanyB filed GC process and I-140 approved as a IT Manager in EB2
    PD=jan 2006
    Still working with H1B from COmpany A
    I never worked for Company B and it no longer exists...
    Company A recently merged with ANother Company X
    I recently got an RFE How do i respond PLease help me:
    Below are the details



    Please submit a properly completcd Form G-325A, Biographic Information Sheet, for yourself. Your original
    signature is required on the Form G-325A. Photocopied signatures are not acceptable. Blank immigration forms
    and information are available online from the official Service website: USCIS Home Page. You may also ordcr
    immigration forms by phone at 1-800-870-3676.


    Submit documentary evidencc to establish your employmcnt history listcd on Form G-325A. Such evidence
    should include, but is not limited to:

    Clear copies ofIRS Form W -2 wage and tax statcmcnts;
    Pay vouchers;

    Complete copies of properly filcd Federal Individual Income Tax Returns (IRS Form 1040);

    Any additional documentation which confirms your employment history.
    You must submit a currcntly dated letter from your intended permanent employer dcseribing your present job
    duties and position in the organization, your proffered position, if different from your current position, the date
    you began employment and the offered salary or wage. This letter must be in the original and signed by an
    executive or officer of the organization who is authorized to make or confirm an offer of permanent
    employment. The letter must also indicate whether the terms and conditions of your employment-based visa
    petition or labor certification continue to exist.
    If you have changed employers since filing your application for adjustment of status, please submit a statement
    which lists the names and locations of all employers you have had in the US and the beginning and end dates of
    each position unless these have been included on Form G-325A.

    We have not done anything to my passport yet. We initially thought of getting my name changed but for now we have kept it in the "to do list".. Not sure when will be able to get to it...

    Frankly I don't know why people think that IT folks cannot qualify for EB2. Inspite of all changes done by DOL, people with 4yr degree + 5 years of exp. can qualify for EB2. If the company can make a good business case and can prove that there are other people (Permanent Residents/ Citizens) in the organization with 4yr degree + 5 years of exp. for same/ similar position, there should not be any issue for the getting an EB2 approved. As far as my knowledge goes, the requirements are set forth in law - that is not something that USCIS can change over night.

    True - it might become more difficult to get approval for such cases, but that does not mean that IT folks cannot qualify for EB2.

    Just my 2cents.

    Also add Project Manager/Project Lead as well.

    My company filed my labour for PM/PL but job classification code is that of SE (Occ. Code 030.062.010)

    I guess any kind of lead activity involves some kind of co-ordination/planning anyways of subordinate SE's.

    I have also seen PM labours under some different occ. code.'s as well something like Technical Manager

    Hi,

    I have been filed in EB2 with a priority date of Feb 26 2007.
    What you guys think about the possibility of my PD getting current this year?
    I know that it needs a crystal ball to predict such horrendun things like PD movement, but I am just trying to get a poll on the general feeling about the spillover this year.

    sfo counsulate charges a fee for endorsement. I recently travelled to India and carried old passport + new passport and PIO card without endoresement. no issues.
    endoresment is needed only if you don't carry your old passport, but I guess you already know that carrying old passport is more beneficial than not carrying it.

    you should use Swift 3D for the initial 3D rendering and animation . its also good to import that animation and any other animations to Flash itself. oh yeah and also you can customize how many times you wish for the animation to loop.

    hope this cleared some of the confusion.

    My PD is current for 12 months (from Oct 2007) .

    Today i got reply for my June 2008 service request, saying my back ground check is not cleared :mad:

    I know from Infopass that my NC is cleared long back.:)

    If your PD is not current cant do any thing but PD is current, contact your local congressman.




    Hi All,

    I opened a service request with USCIS when my I485 was current in 09/08 and i got response saying that still investigation into my background remains open, so the case is not yet ready for decision. I filed my I 485 in August 2005 and in july 2007(then my file was current) also i was told that the background check is still going on.

    Now we know that if it has been more than 180 days after we file I485, no need to wait for background check to process the petetion. My intention is to get my file out of this loop by the time PD becomes current. If any one had this issue and got it resolved, please advise me how i can handle it.

    Yea. Thats true. I will think about it. It is possible to receive receipt in one week under normal circumstances. When I had applied for 140 (Regurlar Processing) in May before the fiasco I received receipt in 3 days.

    Its not a surprise to anyone who is member of this forum that how efficient PEBC works!! As a matter of fact I have an excellent example here with my Labor Certification, which I wanted to share with you all.

    My company just received a latter titled as "Confirmation of Withdrawal" which states that your Labor Processing Application filed in November xx, 2004 is withdrawn, as requested by your letter dated August xx, 2004.

    Isn't that amazing that they are so swamped and desperate in eliminating the backlog that they do not know the chronological order of the dates also?

    Backlog Elimination Centers' are the biggest waste of Taxpayers Money, I think.

    My company wants me to relocate to another state. Because of which I need to re apply for new LC for green card processing. My current approved LC is EB3. My question: To be able to apply for EB2 position, can I use training & experience gained in my current company?

    Everyone, please write to USCIS Ombudsman's office and complain about the issues we are having dealing with USCIS. Also, seek their assistance in having USCIS process our applications in a FIFO manner especially for the transferred cases. Also write to them about slow down in I-140 processing and requesting them to reinstate PP for I-140 petitions. Unless we write and put some presurre, things will not change. You can write about any of the issues you are facing with USCIS as they are available to assist us. I think its worth a shot for us folks.

    I have filed my H1B extension on November as my H1B is expiring on 23rd Feb.
    I haven't got my approval yet. I have currently EAD and my I140 approved.
    My question is if I don't get my approval on or before 23rd Feb what will happen to my status?
    My Lawyer said once you filed you have 140 days (or 160 days forgot) for approval meaning even if it does not get approved on or before I will be on H1B till I complete 140 days from date of filling. Otherwise I will be on EAD status.
    Please advise.

    I am pretty sure that once you have applied for H1 extension you can continue to stay even after the H1 expiry date till it gets approved without having to use or convert to EAD. Confirm this with others too.
